The analysis of the neo-feudal constitution, as an evolution of constitutional deregulation, explores the axiologically retrograde course of modern European constitutionalism due to the revival of patterns or motifs of medieval feudalism. These are patterns or motifs that modern constitutionalism had not fully overcome and that were revived within the framework of neoliberal policies of market liberalization and international trade, the Europeanization of national law, the evolution of technology, and the successive crises of recent years.

Among these patterns or motifs, the doctrine of shared sovereignty stands out, as well as the disorganization of public powers, the multiplication of conflicts between multi-level centers of power, the constant search for conjunctural political compromises, the limitation of the possibility of social advancement of individuals in a state of peace, security, and meritocracy, the transition from a system of government based on law to a system of governance based on conventional bonds of faith and dependence, the expansion of the instrumentalization of law, the escalating privatization of public powers, which in recent years even extends to the claim of the constitutional power itself by reinforced private centers of power, the hybridization of public and private law, the fluidization of law, which nowadays is considered rooted in the common traditions of European states and is subject to continuous negotiation by a community of interpreters who, in a state of permanent emergency, futilely fight among themselves for the privilege of having the last word, as well as the weakening of judicial power in favor of a "clergy" that today has a technocratic character and, with the help of the media and social networks, claims the title of the authentic interpreter of the law.
