The work "Issues from the application of the Off-hire clause in charterparties. Comparative study of English and Greek law" examines a contemporary and highly practical topic in the field of international maritime law. In time charterparty contracts, almost without exception, there are provisions for the so-called off-hire clauses, according to which the charterer is entitled to suspend his continuous obligation to pay the hire, when and for as long as certain incidents described in these clauses actually occur, which hinder the full operation of the vessel.
The study aims to highlight the most significant legal and practical issues arising from the application of the off-hire clause, which has been developed by English contract law, relying for this purpose on the analysis of English case law. The particular characteristic feature of this work lies in the fact that it simultaneously examines the consequences of this clause, in case Greek law is considered applicable to it.
In the first part of the study, various specific issues related to the conditions for the application of the clause are analyzed, while in the second part, the interaction and relationship of the off-hire clause with the other rights and obligations of the parties in the context of the charterparty are explored, with emphasis on those of the charterer, both under English and Greek law.
